The general personal-injury filing period
Georgia generally allows two years after a personal-injury claim accrues to file suit, subject to exceptions. Medical malpractice, wrongful death, injuries to children, and other claims can present different deadline issues. A general website statement cannot calculate the deadline for an individual claim.
Some government claims require earlier notice
Certain government claims require formal notice before the general filing period has run. Some city claims have a six-month notice period. Identify any government vehicle, employee, property, or agency that may be involved so the applicable requirements can be reviewed.
Insurance papers deserve separate attention
Bring the policies and correspondence available to you. Insurance notice requirements, requests for information, coverage disputes, and proposed releases may need attention apart from the lawsuit deadline. An appointment request does not replace a required notice or filing.
Help identify the relevant dates
- Incident date and location and the people or entities involved.
- Dates of treatment, insurer correspondence, and proposed agreements.
- Any notice already sent or received and its envelope or delivery record.
